A little after 5 am Sunday, 16 December in that twilight period when the eastern sky is beginning to show signs of light but the night isn't quite finished yet in the west, a Trooper from Troop D was patrolling I-210 in a 60 mph zone when a pickup truck passed his patrol car at 96 mph.

When the trooper got the vehicle stopped, the driver 34-year-old Kevin L Handy of Lake Charles was arrested with obvious signs of impairment.

At Troop D HQ Handy refused to provide a toxicology sample, details of the arrest were provided to an on-call judge who approved a no refusal search warrant, allowing troopers to obtain blood samples from Handy without his consent. Troopers had also requested a no refusal warrant on an arrest of Handy for his third DWI in October 2018.

Handy was charged with DWI fourth offense, speeding, an open alcoholic container, driving under suspension and no drivers license, and booked into the Calcasieu Correctional Center.
